Terms of Service

These terms govern your use of EU Optikos at euoptikos.com. By accessing the service you accept these terms; if you do not accept them, please do not use the service. The terms are written in plain language but remain legally binding under Austrian law.
1. Acceptance
By creating an account or accessing public content on EU Optikos, you confirm that you have read and accepted these terms and the accompanying Privacy Policy. If you are accepting on behalf of an organisation, you confirm that you have authority to bind that organisation.
2. The Service
EU Optikos is a location-intelligence platform operated by Socintel FlexKapG (trading as Society Intelligence). It provides statistical, event, infrastructure, governance, humanitarian, border, and sanctions data across European Union regions, with AI-powered analysis capabilities. Specific features available to you depend on your subscription tier and your organisation’s configuration.
3. Accounts
- You must provide accurate registration information and keep it up to date.
- You are responsible for maintaining the confidentiality of your account credentials. Two-factor authentication is available and may be required depending on your role and your organisation’s policy.
- Organisation administrators are responsible for managing access for the members of their organisation, including role assignment, member offboarding, and policy configuration.
- You must notify us promptly of any suspected unauthorised access to your account.
4. Subscription Tiers
EU Optikos is offered in three tiers:
- Explorer — free, with access to public data layers and rate-limited API usage.
- Professional — paid subscription with additional data sources, AI features, and increased rate limits.
- Institutional — custom pricing, covering full platform access, dedicated support, and bespoke contractual terms.
Current pricing is published at /pricing. We may change pricing with at least 30 days’ notice for existing subscribers; notice is provided by email to the account-holder address.
5. Acceptable Use
You agree not to:
- Reverse-engineer, scrape, or systematically download data in a way that bypasses or exceeds the published rate limits.
- Use the service to harm, harass, defame, or discriminate against any individual or group.
- Redistribute proprietary or organisation-private data layers outside the platform without explicit written authorisation.
- Attempt to access data belonging to other organisations or tenants, including by exploiting vulnerabilities or misconfigurations.
- Use the AI features to generate misleading, fraudulent, or harmful content.
- Interfere with the security or operational integrity of the service.
6. Data Attribution
EU Optikos redistributes data from seven public and licensed sources. Each source carries its own attribution and licence terms; the complete list is published at /sources. When you cite, publish, or otherwise redistribute observations or events obtained through the platform, you are responsible for complying with the upstream licensor’s attribution requirements.
7. Service Availability
We aim to maintain high availability but we do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where feasible. Service-level commitments are tier-dependent and detailed in your subscription agreement; the Explorer tier is provided on a best-effort basis without SLA.
8. Limitation of Liability
To the maximum extent permitted by Austrian law, Socintel FlexKapG’s aggregate liability arising out of or in connection with your use of EU Optikos is limited to the amount you paid for the service in the twelve months preceding the claim. We are not liable for decisions you or third parties make based on data or analysis surfaced by the platform; the platform is a tool to support analysis, not a substitute for professional judgement.
Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable mandatory law (including, for consumers, the Austrian Consumer Protection Act, KSchG).
9. Governing Law and Jurisdiction
These terms are governed by the laws of the Republic of Austria, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Any disputes arising out of or in connection with these terms shall be submitted to the competent courts in Vienna, Austria. For consumers domiciled in the European Union, the mandatory consumer-protection rules of their country of residence remain applicable.
10. Changes
We may update these terms from time to time. Material changes will be communicated by email to registered users at least 30 days before they take effect. Continued use of the service after the notice period constitutes acceptance of the updated terms. If you do not accept a change, you may cancel your subscription before the change takes effect.
